Welcome to QIAYA Social Content Agent (the "Service"). The Service is operated by Qiaya ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please discontinue use immediately.

1. Service Description

The Service is an AI-powered social media content agent platform. Core functionalities include:

• AI-driven video script generation and video production
• Publishing videos to TikTok via the TikTok Content Posting API
• Video performance analytics and tracking
• Comment monitoring and follower data synchronization

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement.

3. Account and Authorization

Using the Service requires connecting your TikTok account through TikTok's OAuth 2.0 authorization. By doing so, you understand and agree that:

• You are solely responsible for the security of your TikTok account credentials.
• You authorize the Service to perform actions on your behalf within the scope of permissions you have granted (e.g., publishing videos, reading user information, querying video data).
• You may revoke this authorization at any time through TikTok's settings at tiktok.com/setting.
• Upon revocation, the Service will cease all API calls on your behalf and delete your stored authorization credentials.

4. User Responsibilities

When using the Service, you agree to:

• Comply with TikTok's Community Guidelines and Terms of Service.
• Comply with the TikTok for Developers Terms of Service.
• Not use the Service to publish content that is illegal, infringing, fraudulent, harmful, or violates any applicable laws or regulations.
• Bear ultimate responsibility for all content published through the Service.
• Not abuse the Service, including but not limited to malicious requests, reverse engineering, unauthorized access, or any actions that violate TikTok's rate limits or API usage policies.

5. AI-Generated Content

We make no warranties regarding the accuracy, completeness, legality, or fitness of AI-generated content. Any disputes or liabilities arising from AI-generated content are your sole responsibility.

6. Third-Party Services and Platform Compliance

The Service integrates with the following third-party platforms:

• TikTok API (ByteDance) — Video publishing, user information retrieval, data queries. Subject to the TikTok Developer Terms of Service.
• DeepSeek — AI copywriting and script generation.
• Alibaba Cloud DashScope — AI video generation.
• Supabase — Cloud database storage and management.

By using the Service, you also agree to abide by the respective terms of these third-party services. We are not responsible for the availability, performance, or failures of any third-party services.

7. User Data Ownership

Your data belongs to you. We do not claim any ownership rights over your TikTok account data, videos, or any content you create or publish through the Service. We process your data solely to provide the Service functionalities you have requested.

8. Intellectual Property

The software code, user interface design, and documentation of the Service are our intellectual property. The ownership of content generated and published through the Service is determined by applicable laws, regulations, and platform policies.

9. Account Termination and Data Deletion

You may terminate your use of the Service at any time by:

1. Revoking TikTok OAuth authorization in your TikTok account settings.
2. Contacting us at support@qiaya.net to request complete account and data deletion.

Upon receiving a deletion request, we will:

• Delete all your stored data within 30 calendar days.
• Send a confirmation email once the deletion is complete.
• Retain only the minimum data required by law (if applicable).

We also reserve the right to suspend or terminate your access if you violate these Terms, with prior notice when possible.

10. Service Availability

We make reasonable efforts to maintain the stability and availability of the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to suspend or discontinue the Service for:

• System maintenance or upgrades
• Third-party API unavailability or changes
• Force majeure events
• Violations of these Terms

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from use of the Service.
• Data loss or service interruption caused by third-party service failures.
• Any losses arising from AI-generated content.
• Any losses resulting from restriction or suspension of your TikTok account.
• Any losses exceeding the total fees you have paid for the Service in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. For material changes, we will notify you via email or prominent notice within the Service at least 15 days before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the modified Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China. Any disputes arising from these Terms shall be resolved through amicable negotiation. If negotiation fails, the dispute shall be submitted to a court of competent jurisdiction.
